What is Medical Malpractice?
Medical Malpractice is a type of negligence that occurs when a person is injured or dies because a medical professional did not properly use their skills or take proper care when performing his or her duties on a patient.
Not every unsuccessful medical procedure or diagnosis will have grounds for a medical malpractice claim. To prove there is a case of medical malpractice, the injured party must establish that the medical professional or provider did not perform up to the acceptable standard of care given to that profession or facility by the community. The medical provider's error or negligence must also have led to the victim's injuries or death.
Common grounds for medical malpractice can include failure to diagnose, wrong diagnosis, delayed diagnosis, failure to prescribe the proper treatment, surgical errors, wrong prescriptions, errors during nursing care, lack of proper care, lack of thorough care, and lack of informed consent.

Statute of Limitations
In Illinois, the statute of limitations for filing a medical malpractice lawsuit is two years from when the injury took place or the time that the patient realized that an injury due to malpractice might have occurred. However, an adult has no more than four years from the date of the malpractice to pursue a case. In addition, a minor has up to eight years from the date of the medical malpractice incident to pursue a claim. A mentally disabled person may have unlimited time. It is important that you take action immediately.
