1) Can I win punitive damages?
Possibly. Illinois courts will award punitive damages if the defendant’s conduct was particularly outrageous – a “road rage” incident in which the defendant intentionally caused the accident, for example, or a surgeon operating on you while intoxicated. Punitive damages are awarded, if at all, in addition to ordinary compensatory damages.
