1) I was injured in a drunken driving accident. Can I sue the bar that sold alcohol to the driver?
Maybe. The Illinois Liquor Control Act allows victims of intoxicated drivers to collect damages from a bar that sold alcohol to the driver, if and only if the driver’s resulting intoxication actually caused the accident. You don’t need to prove that the establishment had any reason to believe that the driver was already intoxicated when he was served.
2) I broke my hip because I slipped on a wet floor at a grocery store. Can I sue the grocery store?
Perhaps. Owners and renters of property are legally bound to keep their premises reasonably safe for invited guests, including customers of business establishments. If you can prove that the shopping center was negligent and that this negligence caused your accident, you likely have a winnable case.
3) Do I automatically lose if the accident was partly my fault?
Depending on your degree of fault, you could either lose or face reduced damages.
- If you were at least 50 percent at fault, you will lose.
- If you were less than 50 percent at fault, your damages will be reduced but not eliminated.
- If you were not at fault, you will be entitled to 100 percent of your damages.
