You need legal authority to file a lawsuit on behalf of another adult. There are two ways to do this.
- You can use a durable power of attorney executed by your loved one in your favor before he became mentally incompetent.
- You can seek legal guardianship of your loved one be appointed to you by a court, if you meet certain conditions.
3) How long do I have until the statute of limitations deadline expires?
In Illinois, you have two years after the date of the harm to file a personal injury lawsuit; and two years after the date of death to file a wrongful death lawsuit. These deadlines can occasionally be extended for good cause (if the nursing home concealed the real cause of your loved one’s death, for example).
4) My loved one has no written contract with the nursing home. Will this defeat his claim?
No, although it might make enforcing certain types of purely monetary claims more problematic.
