Compassionate Lawyers Serving Victims of Nursing Home Negligence in Lakeview

Lakeview is the second-largest of Chicago’s 77 community areas, and it enjoys the singular honor of hosting Chicago’s beloved Wrigley Field. Over the last two and a half decades we have served a multitude of Lakeview personal injury clients from Sheridan Station Corridor, Boystown, Northhalsted, Southport Corridor, Wrigleyville and Wrigley Plaza, among others.

Sadly, quite a number of these clients came to us complaining about one of the harsher realities of life – nursing home abuse. Among all the different types of personal injury claims, nursing home abuse is the one that distresses us the most. Once abuse is confirmed, it is time to spring into action to immediately halt the abuse and aggressively pursue compensation.

Nursing Home Regulations

Nursing homes are extensively regulated by both the federal government and the Illinois state government. Discovering a regulatory violation and tying that violation to the harm done to your loved one is one of the most effective ways of winning a nursing home abuse claim. At Malman Law, our nursing home abuse attorneys are intimately familiar with these regulations.

Suing Versus Settling

Is it better to sue or to settle out of court? Our general answer is that in many cases it pays to do both – start off with a settlement demand, then file a lawsuit if the other side fails to cooperate. Ultimately, only the ability to win in court will convince a nursing home or insurer that it is best to settle. Even when a lawsuit is filed, a settlement is usually reached before trial.

A Word from a Satisfied Client

Nursing home abuse and neglect

Steve and Kelly were great! The entire process moved much faster than we thought it would. We received a nice size settlement.

I would highly recommend Malman Law!

Types of Personal Injury Cases We Handle

Following are a few of the types of personal injury cases we take.

Frequently Asked Questions (FAQs)

1) What are the most common types of nursing home abuse?

The most common forms of nursing home abuse are:

  • Physical abuse (this includes over-medication for illegitimate reasons such as punishment)
  • Verbal and emotional abuse
  • Sexual abuse
  • Financial abuse
  • Neglect, including insufficient supervision or security and consistent failure to perform any action necessary for proper care.

2) My loved one is mentally incompetent. Can I file a nursing home abuse lawsuit on his behalf?

You need legal authority to file a lawsuit on behalf of another adult. There are two ways to do this.

  • You can use a durable power of attorney executed by your loved one in your favor before he became mentally incompetent.
  • You can seek legal guardianship of your loved one be appointed to you by a court, if you meet certain conditions.

3) How long do I have until the statute of limitations deadline expires?

In Illinois, you have two years after the date of the harm to file a personal injury lawsuit; and two years after the date of death to file a wrongful death lawsuit. These deadlines can occasionally be extended for good cause (if the nursing home concealed the real cause of your loved one’s death, for example).

4) My loved one has no written contract with the nursing home. Will this defeat his claim?

No, although it might make enforcing certain types of purely monetary claims more problematic. Nursing home abuse claims, by contrast, are based on principles of basic human rights, not contractual obligations.  In other words, your loved one doesn’t need a contract clause in order to enjoy the right to be free from abuse.

Malman Law’s Zero Fee Guarantee

At Malman Law, our batting average is .950. That means that, historically, we have brought home monetary compensation for 95 percent of our clients. With that kind of track record, we don’t need to bill by the hour. Instead, our fees are calculated as a percentage of your compensation. Since any percentage of zero is zero, you will owe us nothing unless you win.
