Alabama Jury Awarded $3 Million

On April 11, a jury in Jefferson County, Alabama awarded compensation for a wrongful death lawsuit dating back to December, 2008. The victim, Alan Hager, visited the hospital several times with complaints of severe pain in his gallbladder. What should have been a single visit to the hospital resulted in several admissions and discharges, until ultimately, he died during his third stay.

The court determined that Hager died because his gallbladder needed to be removed, but the presiding surgeon continually elected to postpone the procedure. Unable to justify his rationale, the surgeon lost his case against Hager’s widow.

After her husband’s death, Ms. Hager filed her complaint in December, 2010, citing negligence. While the original complaint named about a dozen other doctors and practices, the recent verdict named only the presiding surgeon and Birmingham Surgical, P.C. as the guilty parties.
