Are Train Accidents on the Rise?

Written by Malman Law, reviewed by Steve J. Malman.

In the past few months, there seems to have been a lot of train accidents regarding pedestrians, vehicles, and even the dubbed “ghost train” that left nearly 30 passengers injured in Chicago. At the end of September, a 95-year-old-man was struck and killed by a train, and just recently, on October 30th, a 34-year-old man was struck by a Metra train. In addition to these accidents, a semi-truck was struck while on train track intersection in October. Train accidents are serious and often serious injuries are the result of them. The impact of a train when involved with a human body is enormous, and often if a pedestrian is struck by a train, they will be killed instantly. While the train accident attorneys at Malman Law encourage safe practices when walking or driving near trains, we understand that sometimes unfortunate tragic accidents still do occur.

While sometimes it is the fault of the pedestrian or driver, there are certain circumstances that can cause a train company to be held liable. For example, a train company can be held liable if a train conductor was under the influence or distracted, if maintenance failed to properly maintain the train, or inspectors who do not thoroughly identify critical problems put its passengers and pedestrians at risk. By law, train companies are required to deliver a safe experience to others. Overall, there are many factors that determine each individual case. A personal injury attorney can help to determine your case accurately.

Most of the recent train accidents are still under investigation by authorities, as they are serious matters to the public. Our attorneys want the victims of these accidents and their families to know that they have legal rights. An Illinois personal injury attorney is available to guide these victims and their families to learn more about the rights that they are entitled to. Malman Law is available 24 hours a day and 7 days a week. Call our firm today for a risk free consultation.
