How long does it take to resolve a personal injury claim?

This is probably by far the number one question that is raised when it comes to personal injury cases. There is no set time allotted to resolve personal injury cases because each case is different, although there are time limits within which a lawsuit must be filed.  There are several factors such as seriousness of the case, nature of injuries, etc. that determine how long it will take to resolve your claim. It is important to have an experienced lawyer involved with your personal injury case in order to make sure things go as smoothly as possible and that your case is resolved in a timely manner.

What can you sue for in a personal injury case?

  1. Medical care and related expenses
  2. Income and wages lost due to your accident
  3. Permanent physical disability or damage
  4. Loss of social, educational, or family experiences such as missing school because of your accident
  5. Emotional damages including stress, depression, embarrassment etc. due to your accident.
  6. Disfigurement
  7. If you are married your spouse can have a claim for the damage to your marriage such as love and companionship
  8. In the instances of death because of the accident, financial losses caused to the deceased’s spouse or other family members

How long do I have to file a lawsuit against those responsible for causing my injuries?

The amount of time you have to file a lawsuit varies state to state. Most states range from 2-3 years. It is important to find out the time requirements in your area. As always it is good practice to hire an attorney soon after your accident occurs so you do not lose the right to file a lawsuit.

Do personal injury claims have to go to court?

In general most cases settle fairly without going to court. However, in some cases it is necessary to go to court in order to get fair compensation for your pain and suffering. When you file your personal injury claim, you should keep in mind that presenting your case in court is always a possibility if it cannot be resolved fairly outside of court.
