Negligence per se is negligence that is established simply by the violation of a safety statute or regulation. In Illinois, however, proving that the nursing home violated a safety rule or regulation doesn’t automatically add up to negligence. The violation will be considered “prima facie evidence of negligence,” and it shifts the burden of proof onto the nursing home to prove that it was not acting negligently.
