Dedicated Nursing Home Negligence Lawyers Serving Clients in Maywood

For a village its size, Maywood, Illinois can boast a surprising density of top-tier medical institutions, including the Loyola University Medical Center and the Hines Veterans Hospital. For those with loved ones needing round-the-clock nursing care, Greater Chicago offers hundreds of nursing homes. Although most are well-run, not all of them provide residents with the level of care that they deserve.

If you entrusted a nursing home with your loved one’s care, it is inevitably distressing when you suspect that the nursing home may have betrayed your trust by abusing your loved one. Indeed, you may be confused. After all, health problems are common among the elderly, and you may not be certain whether or not abuse has actually occurred. We can help you with that.

A Word from a Satisfied Client

Nursing home abuse and neglect

Steve and Kelly were great! The entire process moved much faster than we thought it would. We received a nice size settlement.

I would highly recommend Malman Law!

Types of Personal Injury Cases We Handle

Following are a few of the kinds of cases that we handle. Keep in mind that this is only a partial list.

Frequently Asked Questions (FAQs)

1) What is “negligence per se”?

Negligence per se is negligence that is established simply by the violation of a safety statute or regulation. In Illinois, however, proving that the nursing home violated a safety rule or regulation doesn’t automatically add up to negligence. The violation will be considered “prima facie evidence of negligence,” and it shifts the burden of proof onto the nursing home to prove that it was not acting negligently.

2) What statutes and regulations govern nursing homes in Illinois?

At the state level, the Illinois Nursing Home Care Act applies, while the federal Nursing Home Reform Act also applies if the institution accepts Medicare or Medicaid. Proving the violation of a rule or regulation is one of the best ways to prove a nursing home abuse claim.

3) What types of damages can be sought in a wrongful death lawsuit based on nursing home abuse?

Depending on the circumstances, the following types of damages might be awarded:

  • Medical expenses
  • Funeral and burial expenses
  • Physical pain and suffering
  • Loss of love and emotional support by relatives
  • Other amounts, depending on the circumstances
    • lost earnings by a younger patient who is expected to recover, for example

Which factors determine the value of a nursing home abuse claim?

The value of a nursing home claim is based on a number of factors, including:

  • How much harm was caused by the abuse,
  • How much the victim suffered,
  • How difficult it will be to reverse the harm done, and
  • Whether the harm done is permanent or temporary.

The Malman Law Zero Fee Guarantee

Although we win 95 percent of our cases, we don’t bill our clients until their compensation actually arrives. Since our fees are calculated as a percentage of the compensation recovered, and since any percentage of zero is zero, we don’t charge any fees at all unless we win compensation for you. We won’t pay for nothing, and we don’t think you should have to either.
