Following are minimum (not maximum) coverage limits:

  • Property damage liability: $20,000 per accident
  • Uninsured/underinsured motorist insurance: $20,000 per person/$40,000 per accident

2) Is there a statute of limitations deadline for winning my case?

No, but there is a statute of limitations deadline for filing a lawsuit:

  • Two years after the accident (personal injury)
  • Five years after the accident (property damage)
  • One year after the victim’s death or two years after the accident, whichever is later (wrongful death)
  • Warning – calculating the statute of limitations deadline can be deceptively tricky!

3) Can I sue the employer of the person whose misconduct injured me?

Maybe. In most cases, employers are financially responsible for the on-duty misconduct of their employees. In many cases, however, a worker will be classified as an independent contractor rather than an employee – commercial truckers and Uber/Lyft drivers are a good example. Companies are not responsible for the misconduct of independent contractors.

4) Can I file a personal injury lawsuit over a criminal assault?

Yes, you can file a lawsuit for a criminal assault, including:
