1) Are nursing homes required to issue written policies and procedures?
Yes they are, and failure to do so is a violation of the law. Nursing home residents are entitled to demand to see them or to designate a third party, such as a relative, to view them. The violation of one of these policies can support a nursing home abuse lawsuit if a resident is harmed by the violation.
2) Who can file a personal injury claim if my loved one dies from nursing home abuse?
If your loved one died from nursing home abuse, the personal representative of your loved one’s probate estate may file a wrongful death claim under Illinois wrongful death law.
