1) What are my main legal options if I have evidence of abuse?

You have four main options. Note that these options are not mutually exclusive  –  in fact, if circumstances warrant you can pursue all four at the same time.

2) Are there any regulations that apply to nursing homes in particular?

Yes, regulations have been enacted at both the state and the federal level. Illinois nursing home regulations  govern all nursing homes in Illinois, while federal nursing home regulations apply only to nursing homes that accept Medicare/Medicaid. Violation of a nursing home regulation can be used as evidence of negligence, but is not necessarily dispositive.

3) What types of damages are available in a wrongful death lawsuit over nursing home abuse?

Under the Illinois Wrongful Death Act,  the court may award whatever damages are fair and just. These damages may include (but are not necessarily limited to):

  • Medical expenses
  • Funeral and burial expenses
  • Pain and suffering
  • Mental anguish, grief, loss of companionship, etc., by surviving relatives

4) Is there a valid claim if my mother injured herself due to the nursing home staff’s failure to supervise her?

Perhaps, if you can convince a court that the nursing home staff’s failure to supervise her constituted negligence. Failure to supervise would be more likely to constitute negligence if your mother’s injury was foreseeable in light of her condition, and if the nursing home failed to take appropriate steps to avoid a foreseeable accident.
