Malman Law proudly announces their legal team recently obtained one of Illinois’s largest jury verdicts for nursing home negligence. The case involved the death of a resident as a result of a nursing home’s neglect. At the end of the trial, the jury entered a verdict in favor of the Decedent’s surviving children and husband.
The law firm congratulates attorneys David Resis, Greg Lamorena, and Samantha Malman on obtaining the $5,500,000 verdict before the Honorable Judge Powell. Specifically, the jury awarded $1.5 million for pain and suffering, $3 million for the family’s grief and sorrow, and $1 million for the family’s loss of society. This is one of the largest financial recoveries stemming from Illinois nursing home abuse.
The nursing home attorneys of Malman Law represented the family of an 80-year-old nursing home resident in Illinois who passed away due to negligence. The resident required supplemental oxygen in order to breathe, which she received through an oxygen concentrator.
The power went out in this resident’s room only, and in turn, the oxygen concentrator turned off. As a result, the resident went approximately 20 minutes without supplemental oxygen. Her family reported the power issue to the facility several times, though the nursing home staff did nothing to rectify the issue or ensure she had the oxygen she needed.
After 20 minutes without supplemental oxygen, the resident tragically died. This death would have been preventable had the nursing home staff taken the proper steps to ensure the resident had the supplemental oxygen they knew she needed. They knew of the problem and neglected to resolve it, leading to the wrongful death.
Medical experts estimated that the resident had an additional life expectancy of around six months. The resident left behind a husband and five adult children who suffered due to the nature of the neglect and preventable loss of their loved one.
The defendant nursing home drug the family through five years of litigation and only admitted to liability and causation for the death of the resident one week prior to trial, which kept many of the egregious facts out of the courtroom. At trial, the defendant recommended that the jury award the family $350,000 to compensate the resident for her pain and suffering and to compensate the family for their loss.
Instead, the Malman Law team fought for higher compensation at trial, and the jury returned a verdict of $5.5 million in favor of the resident’s surviving family members. The firm considers this a significant win for not only this resident’s family but for all nursing home residents in Illinois.
