If you or a loved one suffered a brain injury in a work-related accident, you may be able to secure medical and disability benefits through workers’ compensation. At Malman Law, we have decades of experience representing work injury victims and their families throughout Chicagoland.
Brain injuries can happen in an instant, and can change victims’ lives forever. From vehicle collisions to company softball games, almost any situation can put workers at risk for sudden, life-changing brain injuries. If you or a loved one has suffered a brain injury in a work-related accident, the lawyers at Malman Law are here to help you fight for just compensation.
While workers’ compensation is a “no-fault” system, employers and their insurance companies often make it extremely difficult for injured workers to receive the benefits to which they are legally entitled. This is especially true with regard to significant injuries – such as traumatic brain injuries – that can lead to a lifetime of medical expenses and inability to work. At Malman Law, we are committed to ensuring that work injury victims receive maximum compensation to cover their losses. If you or a loved one has been injured at work, we invite you to schedule a free consultation to learn more about your legal rights.
Traumatic brain injuries (TBI) are injuries that result from sudden impacts to the brain. These impacts can range from various types of “closed” brain injuries (where the brain collides with the skull), to “open” brain injuries that involve objects piercing the skull and entering the brain.
Treatment, prognosis, and recovery for TBI vary greatly depending on the specific type of injury. For example, while concussions and whiplash can heal with rest, penetrating injuries from vehicle collisions and other major accidents can require extensive surgery and rehabilitation.
Some of the most common forms of work-related brain injuries include the following. Please note that this list is not exhaustive of the types of injuries that may entitle you to financial compensation.
In order to secure maximum compensation for a work-related brain injury, it is important for victims to understand both (i) the cause of their injury, and (ii) the full extent of their physical, financial, and emotional losses. Whether there are third-parties (such as a product manufacturer, contractor, subcontractor, or trucking company) that are responsible for your injuries or whether your best option is to seek a workers’ compensation settlement, having a full understanding of your situation is critical to making informed decisions about how to exercise your legal rights.
At Malman Law, we have handled thousands of injury claims and secured millions of dollars in compensation for our clients. We can help you evaluate your options and make sure that you receive the largest possible settlement, workers’ compensation award, or court verdict for your losses. All clients receive our “zero fee” guarantee, which means that you pay nothing unless we win your case.
Concussions are easily among the most common types of traumatic brain injuries. During a severe impact (such as during an auto accident, in slip and fall, or from a falling tool or flying object), the brain can bounce against the skull, damaging brain cells and causing chemical changes in the brain. Although concussions are commonly referred to as “mild” brain injuries, they need to be taken extremely seriously. Research has shown that repeated concussions can lead to permanent damage.
Diffuse anoxal injury is also one of the most common forms of TBI, occurring in about half of all cases of severe head trauma. Diffuse anoxal injury affects the nerve fibers in the brain, disrupting nerve activity and impairing the victim’s physical and cognitive abilities. In severe cases, diffuse anoxal injury can leave victims in a persistent vegetative state.
Cerebral edema, or brain swelling, is common with many forms of TBI. With severe swelling, the brain presses against the skull, causing intracranial pressure (ICP) that can deprive the brain of the oxygen it needs in order to function properly.
Subdural hematoma is the buildup of blood between the skull and the brain. Blood collects between the layers that surround the brain, causing pressure on the brain that can lead to unconsciousness, confusion, changes in behavior, other symptoms, and even death. Hematomas are common in accidents involving blows to the head, which can lead to tears in the blood vessels running along the surface of the brain.
The skull is made up of some of the strongest bones in your body. However, in traumatic accidents, even these bones are not impervious to damage. From severe collisions between the head and other objects, to items penetrating the skull, there are actually a number of ways that skull fractures can occur. As one would expect, skull fractures can lead to a wide range of serious (and sometimes fatal) brain injuries.

I was rear-ended by a semi-truck on my way to work. I was transported to the hospital and my car was totaled. In the aftermath, Dan Petrich and Anna Schmidt from Malman Law helped me get set up with physical therapy and negotiated with the insurance companies to make sure the resulting settlement would cover my medical bills and a rental car until I could get a new car. I would highly recommend their services.
